Mr. Austry, as Counsel for the Defendant, moved, by permission of the Court, at one o'clock for a Rule for a New Trial, on the ground of mis-direction. The Rule was refused, and Mr. Austry announced his intention to appeal to the Privy Council.
The facts of the case and the Law also appeared to the Chief Justice so obviously conclusive against the Plaintiff's Claim, that His Lordship did not require any argument from Defendant's behalf.
The Chief Justice was pleased to submit the following topics for the consideration of the Government, suggested by the course of this trial:
1. A modification in the present Jury laws, to ensure the attendance of a proper panel. In the case above reported, it was not until about an hour and a half after the time appointed for the sitting of the Court that they could get a Jury together, although Mr. Smithers went into the Queen's Road to bring into Court any Juror they could find.
